‘Sister Wives’ stars Kody Brown and his four wives won’t be prosecuted in Utah bigamy case

Brown claims Utah County's bigamy statute violates his family’s constitutional rights
SALT LAKE CITY — A Utah prosecutor says he will not pursue criminal charges against a polygamous family made famous by a reality TV show.

Utah County Attorney Jeff Buhman says he has closed the case against Kody Brown and his four wives, who are the stars of the TLC show “Sister Wives.”

Brown moved his family to the Las Vegas area in January 2011 after Utah authorities launched a bigamy investigation.

Brown has since sued Utah County, claiming Utah’s bigamy statute violates his family’s constitutional rights.

Buhman is now seeking to have the lawsuit dismissed, claiming it is moot given the case is closed.

He says his office has also adopted a policy that bigamy cases will only be pursued if there is evidence of a victim or fraud.

Utah prosecutor closes case without charging polygamous family, adopts new policy for charges

SALT LAKE CITY — Criminal charges will not be pursued against a polygamous family made famous by the reality TV show “Sister Wives,” a Utah prosecutor wrote Thursday in federal court filings.

The case against Kody Brown and his four wives — Meri, Janelle, Christine and Robyn — stars of the TLC show, has been closed, Utah County Attorney Jeff Buhman wrote in a motion seeking to have a lawsuit against his county dismissed.

Brown moved his wives and 16 children from Lehi, about 30 miles south of Salt Lake City, to the Las Vegas area in January 2011 after Utah authorities launched a bigamy investigation.

The Browns then sued Utah County along with Utah’s governor and attorney general, claiming the state’s bigamy statute violates their constitutional rights to due process, equal protection, free exercise of religion, free speech and freedom of association.

A federal judge later dropped the state from the case but allowed it to continue against the county.

U.S. District Judge Clark Waddoups said he dismissed Gov. Gary Herbert and Utah Attorney General Mark Shurtleff because Shurtleff had assured the Browns they wouldn’t be prosecuted under his policy that consenting adult polygamists won’t be charged as long as they’re not committing other crimes.

However, Waddoups noted that the Browns had reason to believe they could still face prosecution in Utah County, and agreed it could have a chilling effect on their ability to practice their constitutional rights in the state.

Buhman wrote in his Thursday motion that his county, too, had adopted the same state policy and would not pursue bigamy cases unless there was evidence of a victim or fraud.

“The criminal case against the Browns is closed and no charges will be filed against them for bigamy unless new evidence is discovered which would comport with the office’s new policy,” Buhman wrote.

The Browns’ attorney Jonathan Turley said he was pleased that charges wouldn’t be filed but noted the family didn’t plan to drop the lawsuit, claiming state law remained “blatantly unconstitutional.”

“I want to express our great relief for the Brown family that this long-standing threat has been finally lifted,” Turley said in a statement. “The family has spent years being publicly denounced as felons by prosecutors and had to move to Nevada to protect their family and children.”

Review: S04 Ep03 Brutal Honesty and S04 Ep04 You Asked, Browns Answer

Episode 3: Brutal Honesty


No, Robyn wasn't about to faint, but I must say her face pretty much sums up the excitement  I felt watching not one but TWO episodes tonight. Thank goodness they were only a half hour each, but still, it wasn't exactly what I would call fun.

 Got to admit that's a helluva picture, though! And no, this isn't the Brutal Honesty the title was talking about... at least I don't think it was.


But before we get to the brutal part, we see Logan taking the 'the Pixies' plus Gabriel to a scrapbooking store so the kids can make homemade presents for their dad's birthday. Once he gets parked, the girls (plus Gabriel) all jump out of the van, running and screaming across the parking lot. You can see the reality of the moment hitting Logan hard -  "What have I gotten  myself into?" he asked himself, while simultaneously trying to find Savanah, corral the rest of the pixies,  and prevent Gabriel from diving feet first into the strip mall's ornamental shrubbery. "DON'T LEAVE THE BUILDING!" he yells.

Welcome to adulthood, Logan!

Anyway, it was cute the way he offered crafting techniques to his younger siblings, and frankly, showed a lot of patience. He's gonna miss those kids when he goes off to college! And I think the younger kids are going to miss him, too.

Next we see Christine driving up to Meri's house. Seems the wives are trying to plan for Kody's birthday party. While stuffing gift bags for the children (hm.... what an interesting tradition) the wives also try to brainstorm what to get Kody for his birthday. While Janelle felt Kody should have a good gift, Meri says what Kody does need is a computer and that he's been wanting one. Leave it to Robyn to ask "...can we afford one?" Without missing a beat Meri says " It depends how much we each have in our budgets to put towards it..."

Robyn does not look convinced.  Hey Robyn, we're talking the Browns here. If ya'll can afford a semi-automated assault rifle for Kody, SURELY ya'll can afford a computer! C'mon!! And it was interesting that for the first time, the audience hears the wives each have a household budget.

But is it really prudent to spend money meant to pay household expenses on a birthday gift for Kody? Why does this sound like an episode of 'I Love Lucy'? When the electricity's shutoff for non-payment, is Kody going to stand up and yell "Sister Wives, you got some 'splainin to do!"

We can only hope.

Christine subtracting...
Aw....Truely is soooo cute! Christine and Truely took a short walk over to Robyn's house. Seems Christine wants to put into numbers just how big Sol is and how petite Truely is. Once at Robyn's house, Christine weighs Truely, then Robyn jumps on the scales first holding Sol, then without Sol. Now to be frank with you, I really don't see these two women coming up with the bright idea to weigh Robyn with and without Sol, then subtract the difference. That HAD to be someone's idea in the film crew. And the fact they couldn't subtract 157 from 173 was alarming. I fully expected someone to take off their shoes and start counting their toes. Finally, Christine was able to figure it out. YIKES!! Pretty scary in the meantime.

Oh dear, they are going to a restaurant so Christine can have a talk with Robyn. You know, I am very very tired of watching Christine being publicly humiliated. It's almost like there's some mean girl, demanding that Christine be made to atone for her sins against Robyn and Kody. So what she was jealous and mean to the woman. You would be too. After all, as Christine remembered, Kody's known Robyn for 30 months, and there were cracks in the facade of Christine's marriage to Kody back then(not to mention financial cracks - in the form of bankruptcy for Christine). And while we're at it, don't forget all the canoodling and kissing and acting all lovey dovey stuff Kody and Robyn were doing while Christine was in labor and shown to all the world ( not to mention Christine's AUB family) in season one, and then the attention Kody has given Robyn since the birth of Sol. Yes, Christine surely got the crap end of the stick. And she KNOWS it.

But Christine still must pay her pound of flesh. I'm not going to go into detail about the restaurant conversation, but suffice to say its a good thing this group doesn't practice blood atonement.

And I don't believe for one second Christine is no longer jealous of Robyn.


One question I have, though - why was Christine driving the Lexus? In fact, it was noticeably parked in the driveway on the side of her house. A new peace offering from Kody, perhaps? Or is the car being passed around on a rotation schedule between the sister wives, just like Kody?

Time will tell...

Anyway, seems Christine and Janelle are 'independently' pursuing their real estate licenses. Good for them! But Janelle had a funny look on her face, like she expected Christine to start counting her toes to figure out that one real estate problem!

When Christine said Kody "...had full intentions to do the real estate until he saw the book and he's like 'I've never been one to study...' " Like, duh...like we don't already know Kody is a lazy slug and hates to work?

So of course Janelle had to take control and make sure her man didn't come off looking like the lazy slug he is  with her own spin why Kody dropped real estate. Janelle  explains   "Well, no I think Kody was interested in real estate, but then when the 'marketing' company [i.e. the LIV International MLM]  came along he felt like it was more his skill set..." And then there's an abrupt cut to Janelle in a couch interview saying "...then we decided to pursue the marketing business with some of the other businesses that we have..." Whatever Janelle. You may stand by your man, but it was obvious in the real estate episode last year Kody had no intention of working hard. And real estate is hard.

Now we come to Kody's birthday scene. There's Kody, sitting on his throne wearing his crown and showing off his svelte waistline.

Kody is now 44 years old, believe it or not!

Now we see Kody getting his computer. He says the reason why his reaction was subdued was because he was thinking "...how did they buy this? How can we afford it...Now I have to go to work because a laptop is all about a job..." Funny how he didn't have the same worries about cost when he got that semi-automatic assault rifle that most likely cost just as much if not more than the computer he got.

And of course, leave it to Robyn to chime in "...I kinda knew that Kody didn't really want a laptop completely for his birthday. I knew it wasn't going to be that fun for him..."

Oh just SHUT UP, Robyn... Jiminy Crickets !!

And thus ends episode three...

Episode 4: You Asked, Browns Answer




Several things are apparent in episode four.

The production crew must have run out of ideas. So how about doing a show where the fans ask the Browns questions and then use scenes from previous episodes for visuals. C'mon people, this is only the 4th episode of the season! This type of show may work with normal folk, but we are talking the Browns here...So where a show like this is usually saved until the end of the season,  the audience get to see it at the beginning. Whatever...

If you thought there were going to be any hard hitting questions being asked, you are going to be disappointed. I have to say, one of the stupidest, yes, STUPIDEST questions was: 'I was wondering if you all believed in using protection. Some religions believe sex is solely for procreation...' Kody's been married for 22 years and has 14 children.  HELLO...What do you think?

How about where's the money coming from to finance your life in Vegas? How do you afford 4 houses and numerous new cars? Why do you need 4 houses, won't 2 do? In other words, what happened to those hard hitting questions I saw asked on the TLC Sister Wives facebook page?

If you thought Robyn was not going to cry, think again. That's right, Robyn cries when she answers a question about divorce, and how she was affected by not only her divorce from her children's father, but the divorce of her parents.

Meri gives a warning to all those wannabe 5th sisterwives: Don't come up to her and say you want to join the family as a 5th wife! It's not a matter of numbers, adding a wife is taken seriously (apparently with a lot more thought than shown on the show), and they aren't looking for a 5th, thank you very much.

There were still a couple of interesting questions. For example:

Will there be another wife down the road. Kody took a stand of no because he realizes he is spread too thin as it is. But on the other hand, he can't say never. Kody feels if he had said no more wives after the original three, Robyn wouldn't be in the family today. It was when Robyn said she would strangle Kody if he brought in another wife that a real haha moment happened - that b**** is CRAZY!

A question about jealousy came up. Kody quickly gave Meri the tablet to answer the question, but the camera lingered for a couple of moments on Christine's sad face when she realized Kody wasn't going to give the tablet to her. Maybe that was a good thing...

Homosexuality. Janelle said she didn't have a problem if one of her children came out. I think Christine does have a problem, even though she tried to talk like she didn't. Christine's got some issues, but we already know that. Suffice to say, she implied in her overly drawn out answer that if her daughter was lesbian, she could not have a female friend in her room. Because if she was straight, she couldn't have a boy in her room.

But what if she was bi-sexual, Christine. Have you given any thoughts about that, or will that cause your head to implode?

Anyway, Kody finally replied with the best  scripted answer - "...We have determined we will accept our children with whatever their relationships or their lifestyle is..."

Kody admitted that, yes, he did spend more time with Robyn but it's because she didn't have anyone to take care of her after she had the baby. Why? Because the houses are not together. Oh really? Whatever....

I Scour the Internet: The Pre Memorial Day Edition 5/25/12

HEY WHAT HAPPENED TO THE BOOK TOUR?
Can you believe its been 24 days since 'Becoming Sister Wives' went on sale at a bookstore near you (and also available at the Kody Brown family website) ? And, although the Brown Klowns travelled (with little baby Sol in tow) from Vegas, to New York, then Los Angeles before returning to Vegas talking up their TLC new season premiere and as an after thought their book, what happened to the obligatory book signings at various bookstore locations across the US of A?

The Anderson Cooper and TLC book giveaways do not count. C'mon Browns! I want to see you signing books, and smiling, and answering questions and stuff! You can even have one of those big ole' bottles filled with that green stuff you sell sitting on the table! Hey, I'll even take a swig or two from it!

Is that too much to ask?

Let's take a look at what's been going on with Kody and his Sister Wives. Now, in case ya'll missed it, when the new season of Sister Wives premiered on 5/13/12, not only did  Kody's Konkubines kommit to having one of those fun-filled chats on their FRIEND ONLY Facebook fanpage, their  publisher, Gallery Books, also kommited Kody and his plus fours to tweeting, TWEETING to Twitter fans during the premiere showing!

The Browns. Doing more than one thing at a time. Answering questions. Thinking. Tweeting.

ARE THEY MAD ?!???

Surprise surprise! Even Kody tweeted...at least I think it was Kody. You be the judge....Here's a sampling of the tweets:


Hells bells, Kody. It's HANUKKAH. I suppose we should be thankful you were able to get Joseph Smith right. (For the record, Christine couldn't spell Hanukkah either.)

Oh dear!!! Looks like Robyn may have lost a sale!! Note to Robyn and Meri: Make sure the website is up and running BEFORE you start talking about it! And before your 'fans' have a chance to impulse buy junky jewelry on HSN and QVC , two companies that KNOW how to market and sell merchandise. I don't hate to say this - ladies, this was a MISSED OPPORTUNITY!!

I know its dangerous (I do value my brain and I know I'll miss the brain cells destroyed by my reckless action), but I ventured over to the FRIEND ONLY facebook page. I thought oh well, what the heck. Maybe losing a few brain cells won't be THAT bad.

Well, let me tell you, it was WORTH IT! Seems like Robyn reverted back to her old 'loose lips sink ships' behavior and blabbed something to a fan. Here's a short transcript of the convo.

Enthusiastic Fan: Did you guys open the gym?

Enthused Robyn: Our investor that we did have wanted something different. So we are still looking for the right person. We haven't given up the dream.


So which investor pulled out, so to speak?
Was it the big time gym owner who was seen in a 'business meeting'  with the Browns' last season
OR 
Was it Bill the Trainer - who Kody described as his "... wifes' trainer and new business partner..."

Is it time to retire Fundamental Fitness to the PipeDream Hall of Fame? I think so. One down, four(LIV, MySisterWife'sCloset, Real Estate license, cul-de-sac houses) to go.

Robyn also mentioned to a fan that, despite the show alluding to Hunter and Robyn being brought together by the birth of Super Sol, their relationship still is not very good. Says Robyn "... Things with Hunter are still a little strained but it is ok. I can't worry about it. I just have to love and accept him wherever he is at in his head. He is just a teen."

Well, at least she didn't call him a monster like Kody did last year. But really, Robyn. You've got to stop talking about real stuff that contradicts your reality show!

Oh, interesting to see that Robyn changed her twitter pic from the "Becoming Sister Wives" cover ( which matched Kody's twit pic by the way) back to her old picture featuring Robyn with Kody.

And somebody had an anniversary this week!!


Which is probably a good thing, because according to this tweet, Robyn was feeling kind of down...

Oh reeeeely? Guess Meri and Kody in Mexico would put a damper on things for you.


OUCH !!!! Looks like somebody is asserting her number one status to all concerned. Makes one wonder what precipitated Meri needing to send out such a strong message. An inquisitive fan asking the WRONG question or saying the WRONG thing perhaps? Hmmm.....No wonder poor Robyn has been having a rough couple of weeks.

But a true milestone occurred this week. There's another adult now in the Browns' household!



And before we leave Brownsville, a number of online newspapers have jumped on the Becoming Sister Wives publicity wagon by writing extremely short articles with excessively sensational titles.  For example, examiner.com has an article published 5/23/12 titled 'Sister Wives': Did Kody Brown hide the down side of his polygamist lifestyle? Which talks about Janelle leaving Kody. We already have discussed here on SWB that while Janelle did move out,  she did not leave Kody. 

And huffingtonpost.com has an article titled: 'Sister Wives' Kody Brown: 'None Of My Wives Can Satisfy All My Needs'.

Review: S04 Ep02 Polygamist Date Nights

I really didn't expect a rehash of the Brown's book in the episode tonight. Almost  every recollection about the family's early years was straight from the book. I only will have a few  things to say: Kody looked so effeminate dressed in white at his wedding, didn't he? And what an odd song choice of Bread's 'Everything I Own' - if they were monogamist maybe it would be OK, but polygamist? Too bad Meri didn't get up and sing the Stones 'Beast of Burden'.

First off, we get a glimpse of the LIV company car Kody tweeted about in January of this year (http://sisterwivesblog.blogspot.com/2012/01/i-scour-internet-1412-new-year-tweets.html). My oh my, they must have run out of Mercedes before Kody could get cross country to pick up his car (or the 'marketing' company ran out of dough). If that isn't the UGLIEST little car on the face of this planet. And what color is that? Well at least it looks like it has more leg room in the back seats than the Lexus...Which leads me to ask the inevitable question, Where IS Kody's Lexus? This could be a new game, like Where's Waldo! Is that Kody's Lexus hidden in Robyn's garage? Was that Kody's Lexus found on the road, dead? (No, that was a FORD). Was that Kody's Lexus in the impound yard?

Well, your guess is as good as mine.

Did anyone else catch Robyn's explaining that the 'car' was a 'bonus' Kody earned for THEIR work at a 'marketing' company. Interesting to know that we can just leave off the words Multi Level and just go with the Marketing to describe LIV International. It's so deceptive, don't you think? Kody can barely string 3 coherent sentences together in an interview, so I can just imagine one of his 'marketing' presentations. I hope Meri's driving that car, because she is the driving force behind that bonus car!

But then, with a totally straight face, Meri actually said "...It's a great vehicle...It's fun to have a nice car to go out on a date with...it's fun because...it's a convertible..."Hmmm.... call me silly but shouldn't a COMPANY CAR be used for COMPANY BUSINESS? I mean, isn't that what the Kody Lexus is for, dating? And all this dating talk - these people are acting like they are teenagers instead of adults. Adults with SEVENTEEN children between them.

What is WRONG with these people?

But before I answer that question, let's get on to the first date, with Meri.

When we see Kody and Meri hitting the slopes, and they are going at least 30 mph, who didn't think that this skiing adventure was going to end in a bad way?
Kody even admits...he is a lousy skiing instructor. Yeah, got to agree with you on that one, most instructors make sure their students can stop, and certainly wouldn't have them barrelling down the slopes at 30 mph. Thank God when she wiped out, she didn't take out other skiers too. Too bad about your knee, Meri. Maybe next time you'll take instruction from someone better qualified.

Kody and Meri are not very smart.

With Meri laid up with an injured knee, Kody runs off to his next date with Janelle.

As Janelle and Kody head off to Red Rock Canyon, Janelle explains how liberating it is to know, since working out, that she is now physically able to enjoy hiking and walking wilderness trails again with Kody. But she has only lost 10 pounds. Seriously, I think Janelle should go to a doctor, something isn't right. Last year she said she lost 10 pounds. So is that 10 pounds in totality, or 20 pounds in the last year? Like I said, Janelle needs to go to a doctor, or at least a qualified weight loss professional (sorry trainer Bill or whatever your name was).

Anyway, she appeared to be happy in the wilderness with Kody.

Next, we go to Christine's house. After a brief discussion with daughter Gwendlyn about her decision to ask her brother Logan to take her to the Valentine's dance instead of her father, Christine scurries over to Meri's to help her out.

Kody has a talking head where he says sister wives will discuss their marital problems with their fellow sister wives. Maybe in a perfect polygamist world, but does anyone really think it's prudent to discuss your problems with a rival? And let's be real, these women are all rivals for Kody's attention, and they don't even make an attempt to be even friends. So why should the viewing audience be misled to believe these women are sisterly with each other when clearly, they are not? And that the advice they dish out is anything but self-serving?

When Meri tells Christine to work through her own issues rather than putting her marital problems all on Kody, I just have to wonder, why is he getting let off the hook so easily? Why does Christine have to be the only one to change? Well, if you look deep enough, it's obvious that in this family, when Kody is unhappy, EVERYBODY is unhappy. In fact, hasn't Kody said that what affects one family affects all the families? Since Kody is the common denominator, it doesn't take much effort to come to the conclusion that Kody must be kept happy, even if it means a wife has to change to accommodate HIS whims. Keep sweet and don't make waves is what Meri is telling Christine. And that's just sad. Chalk this segment up to the perks of being a sister-wife: Depression, repressed emotions, loneliness, and jealousy,  just to name a few.

Yep, Robyn's right. It's not for amateurs. And especially not for a self-deluded AUB princess who wanted to be the LAST wife and thought she WOULD BE the LAST wife, but alas, was not.


Just when this episode couldn't get any worse, it's time for Kody's and Christine's date. They go paintballing, and take a helicopter ride from a (wink wink) new buddy of Kody's. Thank goodness TLC is there to not only fund the production crew having to film this crap, but to fund these wonderful excursions.  Hey, did you notice the LIV product placements?

I wonder if Kody and Krew ever thought about taking a cruise on a Love Boat? He needs to become buddies with a cruise company owner. (wink, wink, nudge, nudge)

Back on topic, Kody and Christine end their date at a frozen yogurt parlor, Christine actually APOLOGIZES to Kody. "I'm sorry honey. It's been a rough year...I'll be more grateful, I promise..." she says, sounding more like a child than a wife, let alone a wife who's given birth to 6 children.

"We'll work it out..." says Kody, as he rocks her back and forth. Yeah, right...

We return to Robyn's house. The sounds of children coughing fills the air. Robyn laments about her 4 kids being sick. If you remember, Robyn tweeted about poor [old] Sol [omon Grundy] being sick for about 3 months. THREE MONTHS???? Well, if this segment is any indication, I'm not surprised. Aurora has her face close to Sol's. Sol coughs on her. Breanna kisses Sol. Sol coughs on her. Aurora plays with a doll after Sol coughs on it. Yep, that's how germs and viruses are spread. And then when Kody says that because Sol baked an extra two weeks, the baby has the stamina to weather having the flu for a couple of months. I don't know, but have these two rocket scientists thought maybe if they keep Sol away from sick children or vice-versa,  he would get well? Like, Duh!!!

Has anyone noticed how much Kody is shown holding and cuddling little Sol, and how much Robyn's little girls almost hang on to him for dear life?  Kinda sucks that Truely didn't get the same daddy  TV time, doesn't it?

I think Christine had a point that Kody doesn't appear to allocate his time equally. But that point is now moot, because Christine has promised to be more grateful of the crumbs he begrudgingly doles out to her and their children. And in his talking head, Kody admits that he  "... actually spend more time with each individual wife relationship...Me and one wife....than I do with the whole family relationship." Yeah Kody, we definitely can see that.

For some reason, that saying of Kody's about Love Being Multiplied, Not Divided is simply not adding up in the real world. And who is suffering? The children, of course.

While we watch Kody and Robyn decide what to eat at the restaurant on their date, Robyn talks about being able to leave Sol at home with a teenage bonus kid babysitter when he's older. Hey, where is Sol? Didn't I see Kody carrying Sol in his seat thingy on the way to the restaurant? You would think the baby would be between Kody and Robyn in the booth, but he's not. WHERE IS SOL?

Oh, THERE he is!. It seems that Sol was placed on a chair at the end of the table. Guess Kody and Robyn needed that extra space to cuddle a little closer to each other. And talk about old times. She even pulls out of her purse the string engagement ring Kody gave her, as well as her engagement ring. I wonder if she kept....oh never mind! Anyway, the mystery of Sol's location has been solved!

After listening to Robyn drone on and on (and she does drone in a nasal monotone voice) about Sol's future and that Kody will be 62 when Sol leaves for college. I think to myself I would cut my ears out my head if I had to listen to her drone on and on and on. I tell ya, she's only been a sister wife for a year and a half and already she claims to knows more about being a sister wife than the 3 women who've been together for over 20 twenty years. That takes chutzpah!

I think I'm beginning to see what's wrong with this family, and Christine was RIGHT !

Finally as this hour slowly comes to the end, we find out that Kody checks his kids 'social media' accounts. Oh really? So THAT's why the teen girls were tweeting how they had the greatest dad and family in the world!

And last but not least, for her birthday present, Meri will be spending her anniversary in Mexico (no doubt courtesy of TLC) with Kody.  Let's hope he doesn't teach her how to  water-ski!
